Terms of Use

MAI PRO is an artificial intelligence platform specialised in analysing, interpreting and recommending decisions in marketing and digital performance. Its features cover capital allocation efficiency, campaign assessment, predictive modelling and results optimisation — with the aim of supporting professionals and companies in making data-driven strategic decisions.

By accessing or using MAI PRO, the user declares that they have read, understood and fully agreed to these Terms of Use.

Access to and use of the platform are conditional on full acceptance of these Terms. By using MAI PRO, the user declares that they:

• have full legal capacity to enter into contracts under Brazilian civil law;
• have read, understood and accept all the provisions contained herein;
• will use the platform in compliance with the legislation in force and with industry best practices.

If the user does not agree with any provision of these Terms, they must refrain from using MAI PRO.

MAI PRO provides, among other features:

• analysis and interpretation of digital marketing campaign data;
• integration with the APIs of third-party media platforms, such as Google Ads, Meta Ads and TikTok Ads;
• automated recommendations generated by artificial intelligence models;
• predictive models and campaign performance analyses;
• strategic decision-support tools for marketing and performance.

The user undertakes to:

• provide true, accurate and up-to-date information when signing up and while using the platform;
• use MAI PRO ethically, responsibly and in compliance with the applicable legislation;
• not use the platform for unlawful or fraudulent purposes, or purposes that infringe the rights of third parties;
• ensure that they hold the proper authorisations to share the data of connected accounts (e.g. ad accounts, CRM integrations or other data sources);
• keep their access credentials confidential, being fully responsible for activities carried out in their account.

To the maximum extent permitted by applicable law, MAI PRO:

• does not guarantee financial, commercial or performance results arising from use of the platform;
• is not responsible for business decisions made on the basis of recommendations generated by the platform;
• is not responsible for interruptions, failures, inaccuracies or unavailability arising from integrated third-party APIs or services;
• is not liable for indirect losses, loss of profits (lucros cessantes), actual damages (danos emergentes), non-pecuniary damages (danos morais) or any consequential damages resulting from the use of, or inability to use, the platform.

MAI PRO may connect to third-party services and platforms to extend its features. By using these integrations, the user acknowledges and agrees that they:

• are also subject to the terms of use and privacy policies of the respective third parties;
• expressly authorise MAI PRO to access the data necessary for the activated integrations to work;
• acknowledge that the availability and performance of the integrations depend on external APIs and infrastructures over which MAI PRO has no control.

All intellectual property rights relating to MAI PRO — including, without limitation, source code, algorithms, artificial intelligence models, interface, design, data architecture and documentation — are the exclusive property of MAI PRO or its licensors.

The user is expressly prohibited from:

• copying, reproducing, modifying, adapting or distributing any element of the platform;
• reverse engineering, decompiling or attempting to extract the source code;
• commercially exploiting, sublicensing or assigning any rights relating to the platform without the prior express authorisation of MAI PRO.

Breach of this clause will subject the infringer to the civil and criminal penalties provided for in Brazilian law.

The processing of personal data carried out by MAI PRO is described in our Privacy Policy and complies with the principles and provisions of the Brazilian General Data Protection Law (Lei Geral de Proteção de Dados, Law No. 13,709/2018 — LGPD) and other applicable rules.

By using the platform, the user consents to the processing of their data under the Privacy Policy in force.

MAI PRO reserves the right to suspend, restrict or terminate the user's access, at any time and without prior notice, in the following cases:

• breach of any provision of these Terms;
• conduct that poses a risk to the security, integrity or operation of the platform;
• suspected or confirmed improper, fraudulent or illegal use.

Termination of the account does not release the user from obligations previously assumed, nor does it exclude liability for breaches already committed.

MAI PRO may revise and update these Terms of Use at any time by publishing the updated version on the platform, indicating the revision date.

Continued use of MAI PRO after changes are published will be interpreted as tacit acceptance of the new conditions. If the user does not agree with the changes, they must close their account and stop using the platform.

These Terms are governed by the laws of the Federative Republic of Brazil.

The courts of the judicial district (comarca) of the user's domicile are chosen to settle any disputes arising from these Terms, save where the law provides otherwise or in cases of a special forum (foro privilegiado) provided for by law.
